Question: What is a land contract?
Answer: A Land Contract is an agreement between the property seller and buyer.
When the property seller negotiates the terms of the sale and wants to put that in writing, you’ll need a meeting of the minds how much will be paid. Along with the amount, the date on which the installment payments are to be received, and if it isn’t paid on time will there be any penalties for being late?
How much are the property taxes? How many months will payments be made for? Does the buyer want to pay the remaining balance in full, and will there be any money added because of missed interest payments not received? This is called a prepayment penalty clause. How will the name on the Deed be prior to recording? Is the buyer married, will title be in both names?
